ClariLung Terms of Service

1. Acceptance

By creating an account or using ClariLung you agree to these Terms. If you don't agree, don't use the app.

2. What ClariLung is

ClariLung is a wellness application designed to help you track and manage your journey to quit vaping, smoking, weed, or cigars. ClariLung does not provide medical advice, diagnosis, or treatment. The AI Coach provides general wellness support and is not a substitute for professional medical or psychological care.

3. Eligibility

You must be at least 13 years old to use ClariLung. Sign-up asks for your birth month and year to check this; we don't store them. If you are under 18, you confirm a parent or guardian has agreed to these Terms.

4. Your account

You are responsible for maintaining the security of your account. Use a strong password. Don't share your credentials. You are responsible for all activity under your account. If you suspect unauthorised access, notify us immediately at ceo@duskfieldstudios.com.

5. Subscriptions & payments

Every new account gets a 7-day free trial that starts when you sign up. No card is needed, and nothing is charged when it ends — the app simply asks you to subscribe.

Subscribing is billed the day you subscribe, including when you subscribe during the free trial: the remaining trial days are not added on, and there is no separate free trial on a subscription. Subscriptions are billed through the Apple App Store, Google Play, or Stripe on the web, and renew automatically at the same price and period until you cancel. On the web, cancel any time in Settings → Manage billing; on iPhone or Android, cancel in your App Store or Google Play subscription settings. Cancel at least 24 hours before the end of the current period to avoid the next charge.

6. Refund & cancellation policy

Cancelling a subscription stops future renewals — it does not delete your account or your data, and it does not trigger an automatic refund for time already paid.

• iOS (App Store): Refunds are handled by Apple at reportaproblem.apple.com. Apple's policies — not ours — determine eligibility.
• Android (Google Play): Refunds are handled by Google via the Play Store or play.google.com/store/account/subscriptions.
• Web (Stripe): Email ceo@duskfieldstudios.com within 14 days of the charge. We process Stripe refunds at our discretion; see the full Refund & Cancellation Policy for details.

7. AI Coach

The AI Coach is an AI — software, not a person. It is powered by a large language model run by Groq (or, when Groq is busy, DeepInfra). AI output may occasionally be inaccurate or unsuitable for your specific situation. The coach is not a licensed therapist, counsellor, or medical professional. If you are experiencing a medical or mental health emergency, call 911 or the 988 Suicide & Crisis Lifeline.

8. Acceptable use

You agree not to:

• Abuse the AI Coach with harmful or abusive prompts
• Attempt to access other users' data without authorisation
• Reverse engineer, decompile, or attempt to extract source code from the app
• Use ClariLung to promote vaping, tobacco, or cannabis products
• Scrape ClariLung programmatically beyond what your normal interactive use generates
• Use ClariLung to commit fraud, harass other users, or violate any applicable law

We may suspend or terminate accounts that violate this section without notice.

9. Your data and content

You own the journal entries, craving logs, Coach messages, community posts and replies, and other content you create. You grant Duskfield Studios LLC a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display that content as needed to run ClariLung — which, for community posts and replies, includes showing them publicly to other ClariLung members (under your display name, or an anonymous name if you choose). The licence ends when you delete the content or your account, except for copies in backups until they rotate. See our Privacy Policy for details on data collection, processors, and your rights.

10. Community

Only post what you have the right to share. Don't post anything unlawful, harassing, hateful, sexually explicit, or that encourages self-harm or substance use, and don't post someone else's private information or copyrighted material without permission. You can report a post or reply, or block its author, from the ⋯ menu on it; you can edit your own post or reply for 24 hours and delete it at any time. We may hide or remove content and suspend accounts that break these rules — content reported by several people is hidden automatically until we review it.

Copyright and repeat infringers. We respond to notices of copyright infringement under the U.S. Digital Millennium Copyright Act — see our Copyright & DMCA Policy for how to send one. We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

11. Intellectual property

The ClariLung name, logo, design, code, and all original content provided by us are owned by Duskfield Studios LLC. You may not copy, modify, distribute, or create derivative works of the app or its assets without our written permission.

12. Disclaimer of warranties

ClariLung is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the app will help you quit, that streaks will be accurate, that the AI Coach will always be available or correct, or that the app will be free of bugs or interruptions.

13. Limitation of liability

To the maximum extent permitted by law, Duskfield Studios LLC's total liability to you for any claims arising from your use of ClariLung shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

14. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Any dispute arising from your use of ClariLung shall be resolved in the state or federal courts located in Los Angeles County, California.

15. Changes

We may update these Terms. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Continued use of ClariLung after changes take effect constitutes acceptance.
